The Association of Ukrainian Cities submitted to the Parliamentary Committee on Budget proposals to the draft Law of Ukraine ‘On Amendments to the Law of Ukraine “On the Accounting Chamber” and Other Legislative Acts of Ukraine’ to prevent duplication of powers of state authorities to control local governments, register. #10044-d dated 16.09.2024.
Draft Law #10044-d envisages, among other provisions, the expansion of the powers of the Accounting Chamber to control the funds of local budgets, municipal enterprises, and organisations with municipal property in their authorised capital.
In addition, Article 98 of the Constitution of Ukraine defines the powers of the Accounting Chamber to control the receipt of funds to the State Budget on behalf of the Ukrainian Parliament only.
Moreover, the implementation of the proposed amendments may lead to duplication of functions and powers of the Accounting Chamber with those of the State Audit Service of Ukraine.
Given that the use of public funds to finance the same functions and powers of two state bodies is irrational, inefficient and unjustified, and a violation of the Constitution of Ukraine is unacceptable, the Association of Ukrainian Cities requested that these provisions be removed from draft law #10044-d.
